As a visitor, you can view our vacancies on the applicant platform. If you would like to receive job notifications or apply for an advertised position, registration is required. Your consent to the processing of your personal data in accordance with this data protection declaration for the applicant platform (hereinafter "data protection declaration") is required for this. The data provided will be processed for the purpose of carrying out the application procedure or selecting applicants.

2.       Categories of personal data

This privacy policy applies to all personal data that you provide to us or that we process as part of the application process. The categories of personal data include:

Processing of this type of data is limited to the necessary minimum and is only carried out with the use of additional and appropriate protective measures.

Should we intend to collect sensitive personal data about you from third parties, you will be informed in advance and asked for your consent. Such a survey will not be carried out without your prior consent. If you provide us with sensitive personal data yourself, you consent to the processing of such data in accordance with this data protection declaration.

4.       Data collection and processing

4.1.     Visit and use of the applicant platform

When you visit and use our applicant platform, certain technical information is automatically transmitted to us and logged by your accessing terminal device. This information includes data such as your IP address, the browser you are using, the underlying operating system, etc. The processing of this data is necessary for the provision and secure operation of our applicant platform.

4.2.     Registration and Login

You can register on our applicant platform and thus access further functions such as your candidate profile, notification management, application profiles, etc.. During the registration process, your contact details are required in order to provide you with access to our applicant platform. This information includes (is required): email address, password, first name, last name, residence (country) and account settings, as well as your consent and notification settings. You can delete your registration at any time, which will also delete your candidate profile and your application profiles.

Each time you log in with your user, we also save the date and time of your registration. This allows you to check your last login time and we guarantee an automatic deletion in case of inactivity.

4.3.     Job notifications and career announcements

As a registered user, you can have job notifications and career announcements from the Aebi Schmidt Group sent to you by e-mail. For this mailing service, we use your details and you will receive regular information about vacancies in accordance with the criteria you specify.

4.4.     Candidate profile and application profiles

For your application, we need information about you, which you can store in your personal candidate profile. The data fields of the candidate profile consist of mandatory data that you can change or edit at any time and optional data that you can change or delete at any time. In order to submit an application, it is necessary to fill in all mandatory data fields: Salutation, first name, surname, date of birth, nationality, e-mail, telephone number, street/no., town, canton, postcode, country, your curriculum vitae as document and, if applicable, job-specific information. During each application process, the fields are prefilled with the data from your candidate profile and saved in an applicant profile together with your job-specific data. When data is updated as part of an application process, the corresponding data in your candidate profile is also updated. You can view your candidate profile and your application profiles at any time.

We use your data to efficiently complete the application and selection process and to contact you during the process. As part of the application process, your suitability is evaluated, your data is checked, and all related activities are documented and archived. Only the data entered by you will be forwarded to us. You can withdraw your applications at any time.

4.5.     Tests and assessments

After receiving and reviewing your application, we may ask you to participate in an external online test or assessment, the results of which we take into account when evaluating your application and your suitability for the position. These are various job-specific questions or standardised test procedures. If we carry out an online test or assessment, you will receive an external link from us with corresponding access data.

5.       Legal basis for data processing

5.1.     Processing on the basis of your consent (Art. 6 para. 1a EU-DSGVO)

With your consent to this privacy policy, you consent to the processing of your personal data for the purposes defined in section 4. You can revoke this consent at any time.

5.2.     Processing for the fulfilment of pre-contractual and contractual obligations (Art. 6 para. 1b EU-DSGVO)

The processing of your personal data is carried out for the purpose of recruitment and to justify any subsequent employment contract.

5.3.     Processing on the basis of legal obligations (Art. 6 para. 1c EU-DSGVO)

In addition, the Aebi Schmidt Group is subject to various legal obligations and legal requirements (e.g. archiving, compliance, etc.). The Aebi Schmidt Group orients itself to the legal requirements for processing operations based on the fulfilment of a legal obligation.

6.       Automated decision making and profile building

We do not use automated decision-making procedures when processing your application and we do not process your data for the purpose of automatically evaluating certain personal aspects.

7.1.     Group-wide applicant platform

Your personal data will be collected by the Aebi Schmidt Group company that advertises an open position and carries out the application process. If you are unsure, please feel free to contact the relevant contact information given in the job advertisement.

Your data will be treated confidentially within the Aebi Schmidt Group according to the "Need-to-Know" principle and protected by appropriate security measures. They are only inspected and processed by our employees who are involved in the respective staffing process. This is in particular the respective HR manager and his employees of the responsible personnel department. Line managers only have access to your data from the time when your application for a specific position is shortlisted. Your personal data may be passed on to other Aebi Schmidt Group companies as part of the application process, insofar as this is permissible in the legitimate interest of the Aebi Schmidt Group (Art. 6 Para. 1f EU-DSGVO).

7.2.     service providers

Our service providers for the provision of the applicant platform and possible personnel service providers are contractually obliged to comply with data protection. They are also obliged to handle your data carefully and neither to use it for their own purposes nor to pass it on to third parties. In the context of troubleshooting or further development of our applicant platform, it cannot be ruled out in individual cases that a service provider may have limited access to personal data. We will inform you about the details if required by law.

7.3.     third parties

We undertake not to publish your personal data and not to pass it on to third parties, unless this is prescribed by law, we have an overriding legitimate interest or you have given your written consent. Your personal data may therefore be transferred to state authorities and supervisory authorities (e.g. tax authorities), social security institutions, courts and government bodies, in each case in accordance with applicable law pursuant to Art. 6 para. 1c EU-DSGVO, as well as to external consultants acting as data controllers (e.g. lawyers, accountants, auditors, etc.) pursuant to Art. 6 para. 1f EU-DSGVO.

8.       Cross-border traffic and main storage location

The Aebi Schmidt Group consists of various internationally active group companies. These have common processes as well as a common administration and technical infrastructure. Therefore, your personal data could also be transferred abroad, but not to countries outside the EU or the EEA and Switzerland, or to countries without an adequacy decision of the European Commission (Art. 45 EU-DSGVO).

Your personal data is stored by our contract processor in specially protected computer centres in Europe, St. Leon-Rot (Germany) and Amsterdam (Netherlands). The transmission of the data is encrypted. Our contract processor uses technical and organizational security measures to protect the data from intentional or accidental manipulation, access by unauthorized persons, changes, loss and destruction.

9.       Retention periods and deletion

The storage period of your personal data is subject to the following deadlines:

  • until there are no more applicable legal requirements or limitation periods
  • for the period of the respective fulfilment of the purpose, i.e.
    • Application profiles in case of unsuccessful application maximum 30 days after decision
    • Application profiles for successful applications maximum 30 days after decision
    • Application profiles in case of withdrawal of an application maximum 30 days after withdrawal
    • Inactive candidate profiles (without login and active applications within this period) after a maximum of 365 days
    • Candidate profiles incl. application profiles are deleted immediately if the candidate profile is deleted by the user himself.

We reserve the right to retain your personal data for a longer period of time if your application is successful or if permission is granted by national legislation. If your application is successful, certain personal data from the application process can be saved in your personnel file. You will receive further information about this as part of your recruitment process.

10.    your rights

According to the EU-DSGVO you are entitled to the following rights in connection with the processing of your personal data. Please note that these rights may be limited by applicable national data protection laws.

10.1. Right of access (Art. 15 EU-DSGVO)

You have the right to ask us which of your personal data is used or processed for which purposes.

10.2. Right to rectification (Art. 16 EU-DSGVO)

You have the right to demand from us immediately the correction of incorrect personal data concerning you.

10.6. Right of objection (Art. 21 EU-DSGVO)

You have the right at any time to object to the processing of personal data concerning you which is processed on the basis of Art. 6 para. 1 letter f EU-DSGVO (legitimate interest). If you file an objection, the Aebi Schmidt Group will no longer process your personal data unless there are compelling reasons for the processing worthy of protection which outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.

If you do not agree with the way in which we process your personal data or the processing of your data protection concern, or if you wish to exercise your rights, please send your request to datenschutz@aebi-schmidt.com. For this purpose we need further information to verify your identity and to check your request for appropriateness. A rejection of an unlawful or incorrect request is possible. Some of the rights described in Clause 10 may also be limited if we have a prior legitimate interest or a legal obligation.
